The following Terms of Service (“TOS,” “Terms” or “Agreement”) apply to your use of our website and all services, features and/or content provided by The Ramirez Shift, Ltd. The Ramirez Shift, Ltd. is Doing Business As (DBA) AltShift WP (collectively referred to in this document as “ASWP,” “us,”, “our” ). ASWP is a registered Ohio business located in Toledo, Ohio. ASWP is a reseller of website hosting, domain name registration, and other website hosting related services that are offered by 20i Ltd, a United Kingdom company. By  purchasing one or more Services from ASWP, you declare that you have read, understood and agree to be bound by this TOS. The latest version of our TOS is always available on the ASWP website and will be updated without notice. It is essential that you read this TOS prior to purchasing any Service(s) from ASWP. 

APPLICATION OF TERMS

These TOS apply to all Services provided by ASWP to you throughout the entire Term or Renewal Term. The TOS consist of the following: Terms of Service, Acceptable Use Policy (AUP), Domain Name Agreement, Copyright/Trademark Infringement Policy (DMCA Policy), Privacy Policy, Cookies Policy and Data Processing Agreement. Collectively these documents are referred to herein as the “TOS.” They are referred to by their individual names if a particular paragraph applies to that document alone.

1. Introduction

Welcome to AltShift WP (“AltShift WP”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your use of our web hosting reseller services (the “Services”).

2. Reseller of 20i Ltd. Web Hosting Services

Please be aware that AltShift WP is a reseller of 20i Ltd. Web Hosting Services (“20i Ltd.”). We cannot be held liable or responsible for any changes to the terms of service that 20i Ltd. may make without warning or if they differ from our Terms of Service. 3. Service Outages and Speed Issues

We strive to provide reliable hosting services. However, we cannot be held liable or responsible for any service outages or speed issues originating from the 20i Ltd. network. We will work with 20i Ltd. to resolve the issue as quickly as possible. However, the servers and infrastructure are managed by 20i Ltd., and we have limited capabilities to affect their servers and network.

4. Limited Liability

By purchasing web hosting through AltShift WP, you understand that we are to be held harmless for any service issues. You agree not to sue us or hold us civilly liable for any issues, including losing your website or revenue due to outages. 5. Technical Support

We offer free technical support for your web hosting account during business hours of Monday – Friday 10 AM – 5 PM EST. This support is limited to server issues and errors.

Please note:

WordPress specific errors and coding errors are not covered with free support.
Support for these issues will be directed to WordPress Support and will be billed on a per incident basis.

6. Refunds

We do not offer refunds for our services. However, in the event that our web hosting has caused a major issue in downtime for the client, we may provide a refund to the client as an agreed resolution.

7. Fee, Payments, Renewals, Suspension, and Cancellations

Subscription Service:

Our web hosting is a subscription service. You will be billed monthly on the same day for your service. By purchasing web hosting through our website, you understand you will be billed monthly. We do not offer annual plans.

Payment Processing & Suspension:

If your payment cannot be processed, your account and website will be suspended until payment is made. We will not provide you with your website code or data until your all payments are current.

Cancellations:

You can cancel your service at any time through your My Account area at https://altshiftwp.com/. If you cannot cancel on your own, please contact us and we will cancel you immediately. We are not responsible if you do not cancel before you next payment is processed.

8. Upgrading and Downgrading Web Hosting Plans

If you wish to upgrade or downgrade your web hosting plan, please contact us. This is a process we will need to complete on our end.

9. Customer Account

You can access and manage your customer account at https://altshiftwp.com/

10. HIPAA Compliance or any other compliant

We do not advertise or certify that we are HIPAA compliant or compliant with any other certifications. If you require those types of certifications, do not host with us.

11. Ownership of Website Content

You are the owner of the content on your website. The only exception to this is if the website account is delinquent or if there is another agreement between the customer/client and AltShift WP that overrides this article.

12. Entire Agreement

These Terms constitute the entire agreement between you and AltShift WP regarding the use of the Services and supersede all prior or contemporaneous communications and proposals, whether oral or written.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, United States of America, without regard to its conflict of law principles.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
